e-commerce website

2.
General
2.1 The e-commerce website of Succes Retail B.V. (hereinafter "Succes Retail") offers its customers the opportunity to purchase the goods and services from its web shop online.
2.2
These General Terms and Conditions (“Terms”) apply to any order
placed by a visitor to this e-commerce website (“Customer”) and
the contractual relationship between Succes Retail and the Customer.
When placing an order through the online store of Succes Retail, the
Customer accepts these Terms, thereby agreeing to the applicability
of these Terms, to the exclusion of all other conditions. Additional
terms and conditions of the Customer are excluded, unless they have
been expressly accepted in advance, in writing and by Succes Retail.
3.
Price
3.1 All prices stated are expressed in EURO, always including VAT and all other duties or taxes. Import duties and taxes are not included in the prices and need to paid by the Customer.
3.2
Delivery, reservation or administrative costs are included in the
prices. The shipment of goods is done by Succes Retail, and pick up
on site is not possible.
3.3
The price statement refers exclusively to the articles as described
verbatim. The accompanying photos are decorative and may contain
elements that are not included in the price.
4.
Offer
4.1 Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Succes Retail. Succes Retail is only bound to an obligation of means with regard to the correctness and completeness of the information provided. Succes Retail is in no way liable in the event of manifest material errors, typesetting or printing errors.
4.2
If the Customer has specific questions about, for example, sizes,
colour, availability, delivery time or delivery method, we request
that the Customer contact our customer service in advance.
4.3
The offer is valid as long as stock last and can be adjusted or
withdrawn at any time by Succes Retail. Succes Retail cannot be held
responsible for the unavailability of a product. If an offer has a
limited period of validity or is made subject to conditions, this
will be expressly stated in the offer.
5.
Online purchases
5.1 The ordering procedure is as follows: the Customer places items in his/her shopping cart, then the Customer clicks through to the 'checkout' where an overview of the shopping cart is shown. The Customer must then log in or register with a new customer profile. The confirmation is made via the e-mail address that the Customer provides. After that, the Customer chooses the shipping option in case of purchase of goods and a payment option for purchase of goods or services. The purchase of the goods or services is considered to be concluded when the Customer receives this confirmation e-mail.
5.2
The Customer has the choice between the following payment methods

Succes Retail is entitled to refuse an order due to a serious
shortcoming of the Customer with regard to orders in which the
Customer is involved.
6.
Delivery and execution of the agreement
6.1 Goods ordered through this webshop are delivered to the all countries, except Russia and Belarus.
6.2
Delivery is made by bPost, UPS or another parcel service that
Succes Retail chooses.
6.3
Unless otherwise agreed or expressly provided otherwise, the goods
will be delivered to the Customer's place of residence within 30 days
of receipt of the order.
6.4
Any visible damage and/or qualitative shortcoming of a good or other
shortcoming in the delivery must be reported by the Customer to
Succes Retail without delay.
6.5
The risk of loss or damage passes to the Customer as soon as he (or a
third party designated by him/her,
who is not the carrier) has taken physical possession of the goods.
However, the risk already passes to the Customer upon delivery to the
carrier, if the carrier has been instructed by the Customer to
transport the goods and this choice was not offered by Succes Retail.
7.
Retention of title
7.1 The delivered goods remain the exclusive property of Succes Retail until full payment has been made by the Customer.
7.2 The Customer undertakes, if
necessary, to point out to third parties the retention of title of
Succes Retail, e.g. to anyone who would seize the items not yet fully
paid for.
8.
Right of withdrawal
8.1 The provisions of this article
only apply to Customers who purchase goods and services online from
Succes Retail in their capacity as consumers.
8.2 The Customer has the right to
withdraw from the agreement within a period of 14 calendar days
without stating reasons.
8.3 For goods the withdrawal period
expires 14 calendar days after the day on which the Customer or a
third party designated by the Customer, who is not the carrier, takes
physical possession of the good. For services the withdrawal period
expires 14 days after the day on which the Customer has placed the
order.
8.4 In order to exercise the right
of withdrawal, the Customer must inform Succes Retail,
Brusselsesteenweg 13, bus 33, 3080, Tervuren Belgium,
succes.retail@telenet.be via an unambiguous statement (e.g. in
writing by post, fax or e-mail) of his decision to revoke the
agreement.
8.5 In order to comply with the
withdrawal period, the Customer must send his communication regarding
his exercise of the right of withdrawal before the withdrawal period
has expired.
8.6 The Customer must return or hand
over the goods to Succes Retail, Brusselsesteenweg 13, bus 33, 3080,
Tervuren, Belgium, without delay, but in any event no later than 14
calendar days after the day on which he has communicated his decision
to withdraw from the contract. The Customer is on time if he returns
the goods before the period of 14 calendar days has expired.
8.7 The direct costs of returning
the goods will be borne by the Customer.
8.8 If the returned good is in any
way diminished in value, Succes Retail reserves the right to hold the
Customer liable and claim compensation for any loss in value of the
goods resulting from the use of the goods by the Customer that goes
beyond what is necessary to establish the nature, characteristics and
functioning of the goods.
8.9
Only goods that are in the original packaging, together with all
accessories, instructions for use and invoice or proof of purchase
can be returned.
8.10 If the Customer withdraws from
the agreement, Succes Retail will refund to the Customer all payments
received from the Customer up to that point within a maximum of 14
calendar days after Succes Retail has been informed of the Customer's
decision to withdraw the purchase of the good or the service. In the
case of sales contracts of goods, Succes Retail can withhold
reimbursement until he has received all the goods back, or until the
Customer has demonstrated that he has returned the goods, whichever
comes first.
8.11 Succes Retail will refund the
Customer with the same payment method with which the Customer made
the original transaction, unless the Customer has expressly agreed
otherwise; in any case, the Customer will not be charged for such
reimbursement.
8.12 The Customer cannot exercise
the right of withdrawal for:

Warranty
9.1 Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods (the Guarantee Act), the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.
9.2
To
invoke the warranty, the Customer must be able to present proof of
purchase. Customers are advised to keep the original packaging of the
goods.
9.3
For
items purchased online and delivered to the Customer's home, the
Customer must contact Succes
Retail and return
the item to Succes
Retail
at his expense.
9.4
In
the event of a defect, the Customer must inform Succes
Retail
as soon as possible. In any case, any defect must be reported by the
Customer within a period of 2 months after its discovery. Afterwards,
any right to repair or replacement lapses.
9.5
The
(commercial and/or legal) warranty never applies to defects that
arise as a result of accidents, neglect, falls, use of the item
contrary to the purpose for which it was designed, non-compliance
with the instructions for use or manual, adjustments or changes to
the item, heavy-handed use, poor maintenance, or any other abnormal
or incorrect use.
9.6
Defects
that manifest themselves after a period of 6 months following the
date of purchase, if applicable delivery, are deemed not to be hidden
defects, unless the Customer proves otherwise.
10.
Sanctions for non-payment
10.1 Without prejudice to the exercise of other rights that Succes Retail has at its disposal, in the event of non-payment or late payment from the date of default, the Customer will owe an interest of 10% per year on the unpaid amount, by operation of law and without notice. In addition, by operation of law and without notice, the Customer owes a fixed compensation of 10% of the amount concerned, with a minimum of 25 euros per invoice.
10.2
Notwithstanding
the foregoing, Succes
Retail
reserves the right to take back items that are not (fully) paid for.
11.
Infringement of validity – non-renunciation
11.1 If any provision of these Terms is held to be invalid, illegal or void, this shall in no way affect the validity, legality and applicability of the other provisions.
11.2 A failure at any time by Succes
Retail to enforce any of the rights set forth in these Terms, or to
exercise any right hereof, shall never be deemed a waiver of such
provision and shall never affect the validity of those rights.
12.
Change of conditions
These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to, and the general terms and conditions of Succes Retail. In the event of any contradiction, these Terms and Conditions shall prevail.
13.
Evidence
The Customer accepts that electronic communications and backups can serve as evidence.
14.
Applicable law – Disputes
14.1 These Terms and Conditions are
subject exclusively to Belgian law.
14.2 Any dispute arising out these
Terms and Conditions or that relate to these Terms and conditions are
subject to the exclusive jurisdiction of the Belgian courts.
14.3 The Consumer can also contact
the ODR platform of the European Commission
(http://ec.europa.eu/consumers/odr/).
